ORDER

Please take notice that in order to reduce the number of people coming to court in efforts to limit potential exposure to and/or the spread of Covid-19, the Court will rule on the papers in certain cases rather than require parties to appear for oral argument. This is one of those cases.

Pending before this Court are the following filings: 1) a notice of appeal filed on February 12, 2020 (the "New Notice of Appeal") by defendants Michele Faith and Michael Faith [Note 1] as to the Court's February 4, 2020 post-judgment ruling on plaintiff's motion to dismiss defendants' appeal as moot, or in the alternative for clarification of its rights (the "Ruling") [Note 2]; 2) defendants' Motion to Set or Waive Appeal Bond (the "Bond Motion") relative to this Court's Ruling [Note 3]; 3) a motion to strike defendants' New Notice of Appeal filed by plaintiff [Note 4] (the "Motion to Strike"); and 4) oppositions to the foregoing New Notice of Appeal, Bond Motion and Motion to Strike. [Note 5] (Collectively, the foregoing items 1-4 shall be referred to herein as the "Pending Filings").

As the single justice did not rule on the propriety of the New Notice of Appeal [Note 6] this Court shall rule on the papers concerning the Pending Filings. All written memoranda of law and/or supplemental filings concerning the Pending Filings shall be electronically filed and served not later than 4:00 PM on March 20, 2020, after which time the Court shall rule on the papers without a hearing. There shall be no new motions filed between the date of this Order and March 20, 2020. The limitations concerning the manner and form of filings imposed by Order dated January 17, 2020 shall apply to any supplemental papers filed by the parties in response to this Order.
