ROBERT SLOCUM and JUDITH SLOCUM v. HERITAGE HEATING AND PLUMBING CO., INC.

On January 10, 2007, Robert and Judith Slocum (Plaintiffs) initiated this action by filing a two-count complaint against Heritage Heating and Plumbing Co., Inc., to secure a discharge of a mortgage held by Defendant on property owned by Plaintiffs. Plaintiffs seek a determination of the amount of the debt secured by the outstanding mortgage and ask this court to compel a discharge of the mortgage upon payment of the outstanding debt.
A decision of todays date has issued in favor of Plaintiffs. In accordance with the decision, it is hereby
ADJUDGED and ORDERED that the amount due on the promissory note between the parties is $5,800; and it is further
ADJUDGED and ORDERED that upon receiving payment of $5,800 from Plaintiffs, Defendant shall discharge the mortgage recorded against Plaintiffs Property, which is recorded with Middlesex South Registry of Deeds in Book 43986, at Page 567.
