This case came to be heard upon the Motion for Summary Judgment of Defendant Weston Zoning Board of Appeals and on the Cross-Motion for Summary Judgment of the Plaintiff Marcel Masse, Trustee of 243 Glen Road Realty Trust, pursuant to Mass. R. Civ. P. 56 (b).

An Order allowing the Plaintiff’s Motion and denying that of Defendant Weston Zoning Board of Appeals has been entered this day.

In accordance therewith, it is hereby

ORDERED and ADJUDGED that the Board’s decision rescinding the Plaintiff’s Building Permit is hereby ANNULLED and the underlying Building Permit is reinstated.
