The Plaintiff, Vince Kubic, filed his Complaint in this action on July 20, 2007, seeking declaratory and injunctive relief to prevent Defendants David Audette, Raymond Gifford and Jane Gifford from trespassing on his land and from using a right of way to so-called Webster Lake for activities associated with the Defendants’ proposed construction of a dock in Webster, Massachusetts. A trial was held on March 1, 2010. In accordance with the Decision issued by the court (Cutler, J.) on September 24, 2010, the Plaintiff’s claims are hereby DISMISSED.
