Plaintiff Thomas Boukouvalas, as trustee of the Wood Street Middleboro Realty Trust, applied for and was denied a special permit from the defendant Middleborough Zoning Board of Appeals to convert and use a building on the trust’s property at 255-259 Wood Street in Middleborough as a three-family dwelling. This case is the trust’s G.L. c. 40A, § 17 appeal from that denial.

For the reasons set forth in the court’s Memorandum and Order on the Defendants’ Motion for Summary Judgment of this date, the plaintiff’s appeal is DISMISSED in its entirety, WITH PREJUDICE.
