Plaintiff Thomas Boukouvalas, as trustee of the Wood Street Middleboro Realty Trust, applied for and was denied a special permit from the defendant Middleborough Zoning Board of Appeals to convert and use a building on the trusts property at 255-259 Wood Street in Middleborough as a three-family dwelling. This case is the trusts G.L. c. 40A, § 17 appeal from that denial.
For the reasons set forth in the courts Memorandum and Order on the Defendants Motion for Summary Judgment of this date, the plaintiffs appeal is DISMISSED in its entirety, WITH PREJUDICE.
