JUDGMENT [Note 1]

This case came to be heard on October 5, 2010, on Plaintiff's Motion for Summary Judgment, seeking a declaration that a road discontinued by the Town of Groton in 1932 is not the road which runs through Plaintiff's property and that the road running through Plaintiff's property is still a public road today. A Decision has been entered this day denying Plaintiff's Motion for Summary Judgment. In accordance with that decision, it is hereby

ORDERED, ADJUDGED and DECLARED that the road running past Plaintiff's property, referred to by him as Dan Parker Road, was discontinued by the Town of Groton by the passage of Article 14 at the 1932 Groton Annual Town Meeting.

ORDERED and ADJUDGED that the complaint be and is hereby dismissed.
