This case came on for hearing, was argued by counsel, and thereupon, upon consideration thereof, it was

ADJUDGED and ORDERED that as a result of a certain deed from Arthur W. Duryea, Sr. and Hazel E. Duryea to John William Stubbs and Jeannette I. Stubbs, dated October 21, 1952 and duly recorded in Berkshire South District Registry of Deeds Book 302, Page 109, the grantees therein obtained title to all of the grantors' land situated northerly of Route 23, in the Town of Egremont, County of Berkshire, Massachusetts; and it is

ALSO ADJUDGED and ORDERED that John Bie and Catherine Bie, the grantees in a deed running from Arthur W. Duryea and Hazel E. Duryea, dated May 29, 1961, and recorded with said Deeds Book 330, Page 136 did not acquire title to any land northerly of said Route 23, in said Egremont, by virtue of said deed; and it is

FURTHER ADJUDGED and ORDERED that the complaint be, and it is hereby, dismissed.
