This matter was submitted on a Stipulation of Agreed Facts and Exhibits with Memoranda of Counsel, and it was also argued by Counsel.
In Consideration of the foregoing, it is
ORDERED and ADJUDGED that the Decision of the Zoning Board of Appeals of Chelmsford, dated October 18, 1990 granting the Defendants Kozlowski a variance from the Zoning By-law, exceeded the authority of the Board and accordingly such variance is anulled.
