JUDGMENT

This cause came on to be heard, and thereafter, due to a change in Trial Justice, was submitted by the Parties on the established record. Counsel has filed briefs, reply briefs, and in some instances supplemental briefs; thereupon, upon consideration thereof, it is

ORDERED and ADJUDGED that :

1. Title to the property located at Nos. 4, 6 and 8 Commercial Street, Boston is properly vested in Chatham's Corner Trust, under declaration of trust dated February 20, 1976, registered with Suffolk District Registry of Deeds as Document No. 343892, Gerald F. Kelley, Trustee, as evidenced by Certificate of Title No. 91299;

2. Beneficial ownership of said Trust is:

Walter E. Steele, Gerald F. Kelley and Kathleen Meskell, each 20%; James V., John J., Paul M. and Thomas Murphy, or their legal representatives 40%; JUDGMENT ENTERED ON DOCKET OCT. 19 1992

PURSUANT TO THE PROVISIONS OF MASS. R. ClV. P. 58(a) AND NOTICE SENT TO PARTIES PURSUANT TO THE PROVISIONS OF MASS. R. CIV. P. 77(d) AS FOLLOWS:

3. Attorney John Ottenberg, duly appointed Receiver of Chatham's Corner Trust, shall file his final accounting, as soon as reasonably possible, upon the approval of which he shall be discharged. The books and records of said Trust are to be delivered to said Gerald F. Kelley forthwith. The Receiver may of course first make such copies as may be necessary or incidental to his final accounting.

4. As to Thomas M. Finneran, in all capacities, this matter is dismissed.
