For the reasons set forth in the court’s Decision of this date, the Marblehead Zoning Board of Appeals’ grant of the special permit to defendant Stephen Baratz is AFFIRMED and Mr. Herman’s appeal from that grant is DISMISSED in its entirety, WITH PREJUDICE.
