This action commenced in this court October 16, 2013, with the filing by plaintiff of a verified complaint seeking certiorari review pursuant to G.L. c. 249, § 4.
This case came on to be heard on defendants motion to dismiss plaintiffs complaint.
In an order of even date, the court (Piper, J.) has GRANTED defendants motion to dismiss plaintiffs complaint.
In accordance with the courts order issued today, it is
ORDERED and ADJUDGED that this action, Miscellaneous Case No. 13 MISC 480079 (GHP), is DISMISSED in its entirety, the court determining that it lacks the subject matter jurisdiction needed to hear and decide the matter. This dismissal is without prejudice to the filing of a complaint asserting the same cause of action in a court possessing the required subject matter jurisdiction. It is further
ORDERED and ADJUDGED that no fees, costs, damages or other amounts are awarded to any party.
