JUDGMENT

For the reasons set forth in the court’s Decision of this date and in the Memorandum and Order dated January 12, 2010, it is hereby ORDERED AND ADJUDGED that the plaintiff Town has the right to purchase the forest lot (as defined in today’s Decision) from defendant Brian Caron at a price of $186,500.00, plus the amount of the rollback taxes and release fees paid by Mr. Caron to remove the forest lot from coverage under G.L. c. 61 (if not already returned). It is further ORDERED AND ADJUDGED that the Town shall have 120 days from the date of entry of this Judgment to exercise its right to purchase the forest lot in accordance with G.L. c. 61, § 8. It is further ORDERED AND ADJUDGED that, in the event that the Town exercises its right to purchase the forest lot, upon such sale, the forest lot will no longer be subject to the mortgage lien held by Defendant Michael Sosik pursuant to his May 17, 2005 mortgage.
