SPEICHER, J.
This case commenced October 21, 2013, as an appeal pursuant to G. L. c. 41, §81BB, of a decision (Decision) of the Ludlow Planning Board, approving a modification of a subdivision plan known as Avelino Way in the town of Ludlow, Hampden County, Massachusetts. [Note 1]
This case came on for trial by the court (Speicher, J.). In a decision of even date, the court has made findings of fact and rulings of law. In accordance with the decision issued today, it is
ORDERED and ADJUDGED that the Decision of the Ludlow Planning Board dated October 4, 2013 and filed with the Ludlow Town Clerk on October 7, 2013 did not exceed the scope of authority of the Board; is not arbitrary, capricious, unreasonable or contrary to law; is not legally entitled to be annulled or modified by the court; is AFFIRMED, and shall stand as issued. It is further
ORDERED that todays decision, and this Judgment issued pursuant thereto, dispose of this entire case; the court has adjudicated or dismissed all claims by all parties in this action and has not reserved decision on any claim or defense.
