SPEICHER, J.
This action commenced April 8, 2003 with the filing of a complaint by Lorraine Powell and Barbara Walters, asserting a claim to quiet title pursuant to G. L. c. 240, ยง6, with respect to claims of record title or title by adverse possession by the defendants Anthony Clayborne Jones, Jr., A. Errol Jones and Aaron Ashley to part of the property known as and located at 29 Vassar Street in the Dorchester neighborhood of Boston; specifically, the garage and the land on which the garage stands at said property ("Property").
This case came on for hearing on the plaintiffs' Motion for Summary Judgment and on defendant Anthony Clayborne Jones, Jr.'s Cross-Motion for Summary Judgment. In a decision of even date, the court (Speicher, J.) has determined that judgment shall enter in favor of the plaintiffs and against the defendant Anthony Clayborne Jones, Jr. on all counts.
In accordance with the court's decision, it is
ORDERED, ADJUDGED, and DECLARED, on the sole count of the complaint, that the plaintiffs hold their title to the Property free and clear of any right, title or interest of defendant Anthony Clayborne Jones, Jr., a/k/a Clayborne Jones, a/k/a Anthony C. Jones, ("Jones") and that Jones holds no right, title or interest in the Property as a matter of record, by adverse possession or otherwise; and
It is further
ORDERED and ADJUDGED, that the complaint is dismissed as to defendants A. Errol Jones and Aaron Ashley, said defendants having never been served; and
It is further
ORDERED and ADJUDGED, that the defendant Jones' counterclaim is DISMISSED WITH PREJUDICE, and
It is further
ORDERED and ADJUDGED that this Judgment is a full adjudication of all the parties' claims in this case, and all prayers for relief by any party in this action which are not granted in the preceding paragraphs are DENIED.
It is further
ORDERED that no costs, fees, damages, or other amounts are awarded to any party.
