J. Stephen Bjorklund, Trustee of Atlantis Nature Study Realty Trust (Bjorklund), filed his Complaint on May 1, 2014, naming as defendants Sara J. Trezise, Edward C. Tibbets, John Hallin, Francis M. Lynch, and Anthony J. Bucchere as they constitute the Zoning Board of Appeals of the Town of Scituate (ZBA). The complaint is an appeal from the ZBA's December 4, 2013 decision denying Bjorklunds request for zoning relief to allow for the reconstruction of a non-conforming single family dwelling.
The Plaintiffs Motion for Summary Judgment and the Defendants Cross-Motion for Summary Judgment came on to be heard, and the court (Foster, J.), in a memorandum and order of even date, has denied the Plaintiffs Motion for Summary Judgment and allowed the Defendants Cross-Motion for Summary Judgment.
In accordance with the courts memorandum and order issued today, it is
ORDERED AND ADJUDGED that the Complaint is DISMISSED with prejudice.
