JUDGMENT

For the reasons set forth in the Court’s Decision of this date, it is hereby ADJUDGED and DECLARED:

1. The defendants, Elizabeth DeWitt as Trustee of the Elizabeth Roosa DeWitt 1999 Trust and Dennis DeWitt as Trustee of the Dennis James DeWitt 1999 Trust (hereinafter “the DeWitts”) have no fee or other interest in (1) the private way known as Walnut Place in Brookline, nor in (2) the triangular area between Walnut Place and 94 Upland Road in Brookline, which is marked on the attached Ex. 1 as the “Triangle.”

2. There is no easement appurtenant to 94 Upland Road or any portion of that property to use Walnut Place for vehicular access to or from any part of that property.

3. The DeWitts are ENJOINED from using Walnut Place for vehicular access to and from 94 Upland Road or any part thereof.
