Goodman, Shapiro & Lombardi, LLC (Goodman) filed its verified complaint in this action on December 22, 2014, and its Verified First Amended Complaint filed by Order of the Court (Verified Amended Complaint) on January 26, 2015. The Verified Amended Complaint names as defendants Sandwich Medical and Professional Center Condominium Association; Garry N. Blank individually, as director of the Sandwich Medical and Professional Center Condominium Association and as trustee of the GDBS II Trust; Justin Manning in his capacity as attorney in fact for August Pereira, Jr.; and August Pereira, Jr. (Defendants). On February 6, 2015, Goodman filed its Motion for Summary Judgment (Plaintiffs Summary Judgment Motion) and Defendants filed Garry N. Blank, individually, as trustee and as a director of the Sandwich Medical and Professional Condominium Associations Motion for Summary Judgment and/or Motion to Dismiss (Defendants Summary Judgment Motion).
The Plaintiffs Summary Judgment Motion and the Defendants Summary Judgment Motion came on to be heard on March 3, 2015. In a memorandum and order of even date, the court (Foster, J.) has denied the Plaintiffs Summary Judgment Motion and allowed the Defendants Summary Judgment Motion.
In accordance with the courts memorandum and order issued today, it is
ORDERED and ADJUDGED that the Verified Amended Complaint is DISMISSED with prejudice.
