LONG, J.
For the reasons set forth in the Courts Decision of this date, it is hereby ADJUDGED and DECLARED:
1. The lot size restriction by and between the Trustees of the Surfside Realty Trust and the Nantucket Land Council dated January 15, 1982 and recorded at the Nantucket Registry of Deeds on February 26, 1982 in Book 189, Page 292, and the paper streets restriction by and between the Trustees of the Surfside Realty Trust and the Nantucket Land Council dated January 15, 1982 and recorded at the Nantucket Registry of Deeds on February 26, 1982 in Book 189, Page 289 have both expired, and are no longer enforceable against Lot 13 on Definitive Subdivision Plan D dated August 31, 1981, (approved by the Nantucket Planning Board on October 7, 1981, and recorded at the Nantucket Registry of Deeds in February 1982), now owned by plaintiff Howard Nair as trustee of the Okorwaw Land Trust.
2. Nantucket Land Council, Inc.s G.L. c. 249, §4 certiorari challenge to the Nantucket Planning Boards December 8, 2014 Approval Under the Subdivision Control Law Not Required endorsement of the Plan of Land in Nantucket, Mass. Prepared for Okorwaw Land Trust dated July 7, 2014 by Blackwell & Associates, Inc. is DISMISSED, WITH PREJUDICE.
