HARVEY B. HAEFITZ, a/k/a HARVEY B. HEAFITZ v. PATRICK SULLIVAN and CITIZENS BANK OF MASSACHUSETTS

Harvey B. Haefitz, a/k/a Harvey B. Heafitz, filed this partition action under G.L. c. 241 on April 25, 2016, naming as defendants Patrick J. Sullivan and Citizens Bank of Massachusetts.

Defendant’s Motion to Dismiss came on to be heard on November 9, 2016, and was taken under advisement. In a Memorandum and Order of even date, the court (Foster, J.) has allowed Defendant’s Motion to Dismiss.

In accordance with the court’s Memorandum and Order issued today, it is

ORDERED AND ADJUDGED that plaintiff’s complaint is DISMISSED without prejudice.
