MISC 15-000027

August 22, 2017

Middlesex, ss.

LONG, J.

JUDGMENT

For the reasons set forth in the Court's Decision of this date, the decision filed with the Sudbury Town Clerk on January 16, 2015 of the Sudbury Zoning Board of Appeals granting the defendant Lynne Sullivan's application for a special permit allowing Ms. Sullivan to keep four dogs as personal pets at the property located at 28 Paddock Way in Sudbury is AFFIRMED with the following modification. The condition in the special permit that requires Ms. Sullivan to report complaints to the Animal Control Officer shall not apply to complaints made by the plaintiffs, Lesley O'Keefe and Steven O'Keefe, who, after giving notice to Ms. Sullivan that they will be complaining, must make their complaints directly to the officer, with no obligation on Ms. Sullivan to relay them. The O'Keefes' claims are DISMISSED, with prejudice.

SO ORDERED.
