JUDGMENT

By order of even date herewith, following a hearing on Defendants' motions to dismiss under G. L. c. 184, s. 15(c), this court determined the case should be dismissed. The court treated the motions as having been brought under Mass. R. Civ. P. 12(b)(6), and, as such, allowed them. Accordingly, it hereby is

ORDERED and ADJUDGED Plaintiff is not entitled to specific performance against Jose M. Quintero and has no claim against Carlos R. Castillo as owner of the Property at issue, known as and numbered 7 Sylvia Street, Boston, more particularly described in a deed recorded with the Suffolk Registry of Deeds in Book 57891, at Page 147 on May 3, 2017, based on its Amended Verified Complaint alleging breach of contract, and fraudulent conveyance; it is further

ORDERED that the Memorandum of Lis Pendens endorsed by the court on July 21, 2017, hereby is DISSOLVED; and it is further

ORDERED and ADJUDGED that a copy of this Judgment may be recorded with the Suffolk County Registry of Deeds upon the payment of applicable fees.
