On March 16, 2016, North Charles Mental Health Research and Training Foundation, Inc. (North Charles) filed an unverified two-count complaint against the City of Cambridge (City) pursuant to G. L. c. 240, ยง 14A, and G. L. c. 231A, respectively, seeking a determination that its use of property located at 54 Washburn Avenue, Cambridge (Property) constitutes a General Office use under the Zoning Ordinance of the City of Cambridge (Ordinance). Washburn Avenue Realty Associates, LLC was added as a party plaintiff on November 27, 2018.
In a decision entered this day, the court (Lombardi, J.) denied a motion for summary judgment filed by North Charles and granted a cross-motion for summary judgment submitted by the City. In accordance with that decision, it is hereby
ORDERED, ADJUDGED, and DECLARED that North Charles is a behavioral healthcare service provider and, as such, provides counseling services and talk therapy sessions; and it is further
ORDERED, ADJUDGED, and DECLARED that the use of the Property for behavioral healthcare services, counseling services, or talk therapy sessions does not constitute a "General Office" use under the Ordinance.
