R. THOMAS WALSH v. TOWN OF DENNIS PLANNING BOARD and the TOWN OF DENNIS.

This action, filed pursuant to G. L. c. 40A, §17, and commenced on October 6, 2016, came on to be heard by the court, (Speicher, J.) on the defendants' motion for summary judgment and the plaintiff's cross-motion for summary judgment. In a decision of even date, the court has ALLOWED the defendants' motion for summary judgment and has DENIED the plaintiff's cross-motion for summary judgment and has made rulings of law and ordered the entry of summary judgment. In accordance with the court's decision, it is

ORDERED and ADJUDGED that the decision of the town of Dennis Planning Board pertaining to property at 1341 Route 134 in Dennis, and filed with the Dennis Town Clerk on September 20, 2016, is hereby AFFIRMED, and it is further

ORDERED and ADJUDGED that the plaintiff's complaint, the sole count of which was an appeal of the said decision pursuant to G. L. c. 40A, § 17, is DISMISSED, and it is further

ORDERED that no costs, fees, damages or other amounts are awarded to any party.
