JUDGMENT

On May 20, 2019, Citizens Bank, N.A ("Citizens") filed a Motion to Partially Vacate Judgment and accompanying Memorandum of Law seeking to partially vacate the October 22, 2012 judgment issued in this case. In a memorandum of decision of even date, Citizens' motion was allowed, and in accordance with that decision, it is hereby

ORDERED, ADJUDGED, and DECLARED that the judgment entered in this case on October 22, 2012, recorded in the Worcester County Registry of Deeds at Book 50002, Page 261, is partially vacated to the extent that it affected title to the land conveyed by the deed recorded on October 25, 1984 at Book 8421, Page 252, and shown on the plan recorded in the Registry at Book 526, Page 46; in particular, the Judgment is vacated as to the portion of Lot 16 (as shown on the plan recorded on February 28, 1913 at Book 22, Plan 64) that was conveyed by the aforementioned October 25, 1984 deed. It is further

ORDERED, ADJUDGED, and DECLARED that the tax deed recorded in the Worcester County Registry of Deeds at Book 47605, Page 372 is invalid and of no force and effect to the extent that it affected title to the land conveyed by the deed recorded on October 25, 1984 at Book 8421, Page 252, and shown on the plan recorded in the Registry at Book 526, Page 46; in particular, the tax deed is invalid as to the portion of Lot 16 (as shown on the plan recorded on February 28, 1913 at Book 22, Plan 64) that was conveyed by the aforementioned October 25, 1984 deed. It is further

ORDERED, ADJUDGED, and DECLARED that this action is DISMISSED, to the extent that it seeks to foreclose the right of redemption over land conveyed by the deed recorded on October 25, 1984 at Book 8421, Page 252, and shown on the plan recorded in the Registry at Book 526, Page 46, and in particular, over the portion of Lot 16 (as shown on the plan recorded on February 28, 1913 at Book 22, Plan 64) that was conveyed by the aforementioned October 25, 1984 deed. ORDERED, ADJUDGED, and DECLARED that this Judgment, issued pursuant to the courtÂ’s above-referenced Orders, disposes of this entire case; the court has adjudicated or dismissed all claims by all parties in this action and has not reserved decision on any claim or defense. It is further
