JUDGMENT

Petitioner Janice M. Clark sued respondent Sheila M. Morgan in April 2019 for partition of Unit 651 of a condominium located at 651-643 Summer Street in Rockland, Massachusetts. Clark alleged that she owned Unit 651 with Morgan as joint tenants. Clarke asked that Unit 651 be sold and the proceeds of the sale divided equitably.

Ms. Morgan answered Ms. Clark's petition in May 2019. Morgan agreed that Unit 651 should be sold. The parties jointly sold the Unit and deposited the proceeds of that sale (the "Proceeds") with the Recorder of the Land Court. The parties then appeared for trial on February 5, 2020 over the division of the Proceeds. In accordance with the Decision issued this day, the Court:

ORDERS, ADJUDGES, and DECLARES that Janice M. Clark's Petition for Partition is GRANTED;

ORDERS, ADJUDGES, and DECLARES that Ms. Clark is entitled to $127,353.08 of the proceeds of the sale of Unit 651, as deposited with the Recorder on October 25, 2019 (the "Proceeds"), plus one half of the interest that has accrued on the Proceeds through the date of disbursement by the Recorder (the "Accrued Interest");

ORDERS, ADJUDGES, and DECLARES that Sheila M. Morgan is entitled to $140,565.58 of the Proceeds, plus one half of the Accrued Interest; and

ORDERS the Recorder of the Land Court to disburse promptly to Ms. Clark and Ms. Morgan, but no earlier than April 27, 2020, the amounts described in the two preceding sub-paragraphs.
