JUDGMENT OF DISMISSAL

Plaintiff James Bigelow petitioned this Court in July 2019 pursuant to M.G.L. c. 240, ยงยง1-5, to compel defendant Reem Property, LLC to try its title to a residential property at 33 Whiting Road in Oxford, Massachusetts. Bigelow also sought a preliminary and a permanent injunction preventing Reem from levying on an execution for possession of the property granted by the Central Housing Court in May 2019, as well as damages under M.G.L. c. 93A for Reem's alleged unfair trade practices.

In August 2019, Reem answered Mr. Bigelow's complaint. In September 2019, Reem moved for summary judgment. After reviewing the parties' briefs and memorandums, and having heard them at oral argument, for the reasons set forth in this Court's Decision dated today, the Court GRANTS Reem's motion for summary judgment. Accordingly, the Court:

ORDERS and DECREES that James Bigelow's petition to try title is hereby DISMISSED with prejudice; and

ORDERS and DECREES that Mr. Bigelow's claims under M.G.L. c. 93A are hereby DISMISSED without prejudice.

SO ORDERED.
