89 BEACON STREET, LLC, Plaintiff, v. 88 BEACON STREET CONDOMINIUM TRUST, Defendant

This case commenced in the Land Court June 10, 2020. By electronic mail message to the Recorder's Office on November 4, 2020, the parties reported the case settled, and requested that the case management conference scheduled for November 5, 2020, be canceled, and that the court issue a nisi order to allow the parties time to implement their settlement agreement.

Accordingly, it is

ORDERED that the November 5, 2020 case management conference be CANCELED and that all proceedings in this action be stayed for a period of thirty (30) days from the date of the parties' reported settlement, November 4, 2020, during which time they shall proceed in good faith and with all possible diligence to execute, deliver, and, if necessary, acknowledge and record papers implementing their reported settlement. Within the same time, the parties shall file a stipulation of dismissal pursuant to Mass. R. Civ. P. 41(a)(1)(ii) or an agreement for judgment. If a stipulation of dismissal or agreement for judgment is not filed on or before December 4, 2020, then, absent further order of the court, judgment will enter on or after December 7, 2020 in this case, dismissing it as to all parties and claims.
