TONY NGUYEN and MARY NGUYEN, Plaintiffs, v. ROCIO LOPEZ and SANTOS LOPEZ, Defendants

This action commenced on June 15, 2020, when Tony Nguyen and Mary Nguyen ("Plaintiffs") filed their Complaint and Jury Demand (the "Complaint") against Rocio Lopez and Santos Lopez ("Defendants") alleging that Plaintiffs possess a perpetual right to construct and use a driveway over 92 Myrtle Street Brockton, MA, 02301 (the "Property") for the benefit of 90 Myrtle Street Brockton, MA, 02301 and maintain exclusive possession of the driveway. On August 7, 2020, Defendants filed their Answer To Complaint, Counterclaim and Jury Demand alleging the Property to be free of any interest of the Plaintiffs' (the "Counterclaims"). On September 22, 2020, the day before a scheduled status conference, counsel for both parties reported the case as settled, but needed time to finalize their settlement.

In an email received by the court on November 4, 2020, on which counsel for both parties were copied, counsel for Defendants advised court that the parties were memorializing a settlement agreement and requested that a sixty (60) day NISI Order issue.

Accordingly, it is ORDERED that on or before January 8, 2021, the parties shall file a stipulation of dismissal or agreement for judgment for the Complaint and Counterclaims. If the parties fail to file such a stipulation or agreement for judgment, the court shall dismiss the case with prejudice.
