CARMEN L. MATHESON, individually and as Executrix of the Estate of Robert B. Matheson v. LEHMAN BROTHERS HOLDING, INC. a/k/a LEHMAN CAPITAL

This case came to be heard on the Motion of the plaintiff for Summary Judgment.

An Order allowing the said Motion has been entered this day. In accordance therewith, it is hereby

ORDERED, ADJUDGED and DECLARED that the Mortgage dated January 16, 1987, recorded with the Plymouth County Registry of Deeds (Registry) at Book 7449, Page 315 and the subject of an Assignment recorded with the Registry at Book 10282, Page 254 (Mortgage), is hereby discharged and of no effect.

It is further

ORDERED, ADJUDGED and DECLARED that the plaintiff holds title to the locus at 122A Samoset Avenue, Hull, Massachusetts, free of any cloud attributable to he the failure to record a discharge of the said Mortgage.

It is further

ORDERED and ADJUDGED that upon payment of the appropriate fee, the plaintiff is hereby authorized to record a copy of this Judgment with the Plymouth County Registry of Deeds.
