JUDGMENT

For the reasons set forth in the Court’s Decision of this date, the Plymouth Zoning Board of Appeals’ decision denying the Zamperinis’ application for a special permit and variance modification is REVERSED. Once the Planning Board approves an RDD plan, the Zoning Board is hereby ORDERED to issue a special permit for roadway improvements under §205-17(E)(3)(b) and remove the condition against further subdivision of Lot 5 from the 1997 variance (Case No. 2801) subject to the Zamperinis’ grant of the 40’ easement shown on Exhibit 2, attached to the Court’s Decision.
