This case came to be heard on the Plaintiff’s Motion for Summary Judgment, pursuant to Mass. R. Civ. P. 56 (b). An Order allowing the Plaintiff’s Motion has been entered this day. In accordance therewith, it is hereby

ORDERED, ADJUDGED and DECLARED that the plaintiff Eugene Lepesqueur possesses an easement by estoppel over the way known as Cobble View Road in Williamstown, Massachusetts. It is further

ORDERED and ADJUDGED that the defendants, their agents, servants, employees, attorneys, and all other persons in active concert or participation with any of them who receive actual notice of this Judgment by personal service or otherwise, are permanently enjoined and restrained from obstructing or interfering with the vehicular access, ingress or egress, to the lots which are currently owned by the plaintiff and are as depicted on the Stratton Plan referenced in this court’s Order of even date.
